1. Introduction
These Terms of Service ("Terms") govern your access to and use of April ("the Service"), an AI-powered customer service agent platform operated by 1070 AI Labs, a company registered in Pune, Maharashtra, India ("Company", "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
April provides an AI-powered customer service agent platform that enables businesses to create, train, and deploy intelligent chatbots on their websites. The Service includes:
- Chatbot creation and configuration with customizable appearance and behavior
- Knowledge base management through file uploads, website crawling, and manual text input
- AI-powered conversational responses using advanced language models
- Embeddable chat widget for deployment on customer websites
- Analytics, conversation logs, and lead capture features
- API access for programmatic integration (where available on your plan)
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. By creating an account, you represent that you meet these requirements.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us at support@theapril.app if you become aware of any unauthorized use of your account.
3.3 Accurate Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate accounts with inaccurate or incomplete information.
4. Subscription Plans and Pricing
4.1 Plans
The Service is offered through multiple subscription tiers, including a free plan with limited usage and paid plans with increased quotas and features. Current pricing and plan details are available on our website at theapril.app.
4.2 Billing
Paid subscriptions are billed in advance on a monthly or annual basis depending on the plan selected. All fees are quoted in US Dollars (USD) unless otherwise stated. You authorize us to charge your designated payment method for all applicable fees.
4.3 Price Changes
We reserve the right to modify our pricing at any time. Any price changes will take effect at the start of your next billing cycle. We will provide at least 30 days' notice of any price increase via email or in-app notification.
4.4 Taxes
All fees are exclusive of applicable taxes (including GST, VAT, or sales tax). You are responsible for paying all taxes associated with your use of the Service. We will add applicable taxes to your invoice where required by law.
5. Refund Policy
All payments made to April are final and non-refundable. This includes but is not limited to subscription fees, plan upgrades, and any other charges. By subscribing to a paid plan, you acknowledge and agree that:
- No refunds will be issued for any reason, including but not limited to dissatisfaction with the Service, failure to use the Service, accidental purchases, or early cancellation of a subscription.
- If you cancel your subscription, you will retain access to paid features until the end of your current billing period. No prorated refunds will be issued for unused time.
- Downgrading from a higher-tier plan to a lower-tier plan does not entitle you to a refund for the difference in plan costs.
We strongly encourage you to use the free Starter plan to evaluate the Service before committing to a paid plan.
6. Acceptable Use Policy
6.1 Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service solely for legitimate business purposes, including customer support, lead generation, and information dissemination through AI chatbots.
6.2 Prohibited Activities
You agree not to use the Service to:
- Violate any applicable local, state, national, or international law or regulation
- Generate, distribute, or facilitate spam, phishing, malware, or any form of unsolicited communication
- Create chatbots that impersonate real individuals, organizations, or government entities without authorization
- Distribute, generate, or store content that is defamatory, obscene, pornographic, abusive, threatening, harassing, or otherwise objectionable
- Engage in any activity that is discriminatory, hateful, or promotes violence against any individual or group
- Collect, store, or process personal data of end users in violation of applicable data protection laws (including GDPR, CCPA, and India's Digital Personal Data Protection Act)
- Attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks connected to the Service
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
- Use the Service to develop a competing product or service
- Circumvent or manipulate usage limits, quotas, or billing mechanisms
- Use the Service for any fraudulent, deceptive, or misleading purpose
- Upload content that infringes on the intellectual property rights of any third party
- Use the Service to provide medical, legal, or financial advice without appropriate professional oversight and disclaimers
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
6.3 Consequences of Abuse
Any violation of this Acceptable Use Policy, any form of abuse of our services, products, team, or infrastructure, or any unethical conduct as determined at our sole discretion, will result in immediate termination of your account without prior notice and without any refund. We reserve the right to report illegal activities to the appropriate law enforcement authorities. Terminated accounts will lose access to all data, chatbots, and configurations associated with the account.
7. Intellectual Property
7.1 Our Intellectual Property
The Service, including its original content, features, functionality, design, and underlying technology, is and will remain the exclusive property of 1070 AI Labs and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of India and international treaties.
7.2 Your Content
You retain ownership of all content you upload, create, or input into the Service ("Your Content"), including documents, text, website data, and chatbot configurations. By uploading Your Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, store, and display Your Content solely for the purpose of providing and improving the Service.
7.3 AI-Generated Responses
Responses generated by the AI using your knowledge base are derivative of Your Content. You are solely responsible for the accuracy, legality, and appropriateness of all content served through your chatbots, including AI-generated responses.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.
You are responsible for ensuring that your use of the Service complies with all applicable data protection laws in your jurisdiction, including obtaining any necessary consents from your end users before collecting their data through the chatbot widget.
9. Service Availability and Modifications
9.1 Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as available" basis. We may perform scheduled maintenance that temporarily affects availability and will endeavor to provide advance notice where practicable.
9.2 Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that materially affect your use of the Service.
10. Third-Party Services
The Service integrates with and relies on third-party services for certain functionality (including AI model providers, payment processors, hosting providers, and analytics services). We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is subject to their respective terms and privacy policies.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- In no event shall 1070 AI Labs, its directors, employees, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
- Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
We do not warrant that AI-generated responses will be accurate, complete, reliable, or error-free. You acknowledge that AI technology has inherent limitations and you are responsible for reviewing and validating chatbot responses for your use case.
12. Indemnification
You agree to indemnify, defend, and hold harmless 1070 AI Labs and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of a third party, including intellectual property rights
- Content uploaded, published, or transmitted through your account
- Any claims made by your end users relating to the chatbot or its responses
13. Termination
13.1 Termination by You
You may cancel your subscription and close your account at any time through the Service's billing settings or by contacting us at support@theapril.app. Cancellation takes effect at the end of your current billing period. No refunds will be issued for unused time.
13.2 Termination by Us
We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms or the Acceptable Use Policy. Upon termination, your right to use the Service will immediately cease.
13.3 Effect of Termination
Upon termination of your account, all data associated with your account (including chatbots, sources, conversations, leads, and configurations) will be permanently deleted within 30 days. We are not obligated to retain or provide copies of your data after termination. We recommend exporting any data you wish to keep before terminating your account.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
Before initiating any legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at support@theapril.app. We will attempt to resolve the dispute within 30 days of receiving your notice.
15. Changes to These Terms
We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 15 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
16. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and 1070 AI Labs regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
- Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, government actions, internet outages, or third-party service failures.
